Terms and Conditions of Business
These terms of business form a contract between iSTEM Consulting Pty Ltd (also known as iSTEM Co.) and employers who have successfully engaged our iSTEM Co. platform or related entities to recruit candidates.
iSTEM Co. is a service-based recruitment company that offers talent sourcing and recruitment services for a finders fee. We have three main service offerings including:
- Direct Recruitment is based on a finders fee of 12% of the candidate’s salary paid upon offer.
- Tryout to recruit program is based on a finders fee of 10% of the candidate’s proposed salary paid upon offer. Payroll management service, if requested, fees apply.
- Mentoring Retention Program for the Tryout candidates is $3000 per intern and $5000 for direct recruits or women in STEM early career professionals of a business, particularly those who identify as women of colour/CALD. The program provides tailored mentoring including an onboarding at the beginning, midway and feedback check-ins with the candidate and their direct line supervisors to monitor progress and improve their assimilation and retention into the business and overall success in the career journey.
The finder’s fee will be due and payable when an offer for any type of employment has been extended by a client and accepted by a candidate, through the efforts of iSTEM Co. or any related entities irrespective of referral method or position type. The client agrees to advise iSTEM Co. within 24 hours of an offer and/or acceptance of a position by an iSTEM Co. or related entities referred candidate. iSTEM Co. requires notice within 24 hours if a referred candidate fails to start, leaves or is terminated within the guarantee period.
Our standard trading terms are 14 days from the date of invoice and all fees quoted are exclusive of GST. The client is liable for all reasonable expenses and legal costs incurred by iSTEM Co. or its related entities for enforcement of obligations and recovery of monies due from the client. The above terms and conditions including our trading terms must be met for our guarantee to take effect. Interest may be charged at the rate of 1.5% per month on overdue accounts.
For our direct recruits, while we aim to match candidates to suitable employers, we cannot guarantee that the candidate is the best fit for the role. We will endeavour to replace a candidate within 3 months of beginning a role if it is deemed that the candidate is not appropriate for the role for direct recruits only. This does not apply to our ‘Tryout to recruit’ candidates as the program aims to provide work experience for the candidates.
Our replacement guarantee applies in the event that the candidate either of their own accord or for reasons relating to unsatisfactory performance in the position is terminated within the first 3 months of commencement. We must be informed within seven (7) working days of termination and have exclusive rights to provide a replacement candidate. Our guarantee policy will not be applicable if the original placement invoice is not paid by the due date. Also, our guarantee policy does not apply for conditions beyond iSTEM Co.’s control, including but not limited to the following: retrenchment, restructuring or significant job change, unforeseen medical problems, retirement, unsafe working conditions, misrepresentation of position, workplace bullying, harassment, discrimination, and unfair dismissal. If the replacement is at a higher salary, the cost difference to the original placement will be payable. No refund is applicable to the client if the replacement salary is lower than the original placement. Additional advertising and other costs incurred in making a replacement may be charged to the client.
Also, while we aim to provide an optimum browsing experience, we will not be accountable for any delays or interruptions to the website. We will not be responsible if the website is down for any reason and as a result, there is loss, cost, damage or liability.
While we wish our users to have a great experience on our website, there are certain practices that we do not allow:
Using the website to post or transmit information that breaches any laws or regulations, infringes a third party’s rights, or affects other users including defames, harasses, threatens, menaces, offends, or restricts any person
Sending unsolicited email messages or transmitting contents that contain viruses.
The Website, including its software, design, graphics, and copyright, is owned or under license by iSTEM Consulting Pty Ltd and protected by Australian and International laws. While using the website, you do not have permission to use any of the trademarks or logos, as well as copy or reproduce any content without the permission of iSTEM Consulting Pty Ltd.
In accordance with privacy legislation, employers using iSTEM Co. or related entities shall not disclose any information regarding the candidates to any other party and agrees to destroy all resumes and application details of unsuccessful candidates.
By using the Website, the client is responsible for any risk and indemnifies iSTEM Co. and its related entities from any claim or loss, suits, actions, damage or liability incurred as a result of using the iSTEM Co. platform or any related entities.
Workplace Health and Safety
For Tryout to recruit candidates sourced via iSTEM Co. and its related entities, iSTEM Co. will require the client to provide and maintain a healthy and safe working environment with appropriate tools, equipment, and systems for workers and to undertake site-specific induction.
Nominated representatives of iSTEM Co. shall be permitted to inspect the workplace to assess WH&S factors prior to the candidate’s commencement and at periodic intervals.
At commencement, the client agrees to arrange an induction for the candidate in work practices, processes and safety procedures. In the event that a candidate is directed to perform a new role or in a new location, further induction must be completed and iSTEM Co. must be notified.
Any incident or grievance must be reported to iSTEM Co. within 24 hours, and documented evidence/reports must be provided. The client agrees to inform iSTEM Co. of any injury sustained by a ‘Tryout to recruit candidate’ as soon as practicable and to provide copies of injury reports and accident investigations.
The client agrees to assist iSTEM Co. in providing suitable assignments for candidates who are returning to work following an injury that was sustained when previously employed by your organization.
Tryout to Recruit Candidates Conversion to Direct Recruits
If a ‘Tryout to recruit’ candidate is offered permanent work by the client or a related company, be it full-time or part-time, the direct recruitment charge of 12% will now apply as opposed to the tryout of 10%.
As part of our service, we complete employment and personal reference checks with the candidate’s consent and with regard to the privacy and confidentiality requirements of both parties. Pre-employment checks such as police, medical, and competency assessments will be completed at the request and expense of the client.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Australia.
iSTEM Consulting Pty Ltd reserves the right to terminate your access to the website and its services without notice and at its sole discretion.
